Definitions and Interpretation
In this Privacy Policy:
  • Advertisement means any advertisement placed, or sought to be placed, on the Website;
  • Advertiser means any person placing or seeking to place an advertisement or any other content on the Website;
  • Applicable Laws means all applicable national, state, local and municipal legislation, regulations, statutes, by-laws, and other laws and any other instrument or direction from officials having the force of law as may be issued and in force from time to time;
  • Personal Information means any information relating to individual Users, including a User’s name and contact details such as email address and telephone number, information to enable us to check and verify a User’s identity, location data from mobile devices and a User’s billing information, transaction and payment information and history;
  • Privacy Policy means this privacy policy;
  • Terms means the current edition of the terms and conditions of use published on the Website;
  • User means any user of or visitor to the Website, whether active or passive, including Advertisers;
  • we, us and our refer to City Glow Properties LLC, the operator of the Website;
  • Website means https://www.cityglowproperties..com/ and any subsidiary or related pages; the words ‘including’ and similar should be construed without limitation; references to a ‘person’ includes a natural person, legal person, a firm, a body corporate, an unincorporated association, or an authority, and such entities’ legal successors; a word that suggests one gender includes all genders; a singular word includes the plural and vice versa; and headings are for convenience only and do not affect the interpretation of this Privacy Policy.
Application

This Privacy Policy applies to all Users of the Website. A User’s right to access the Website is conditional on acceptance of this Privacy Policy and the Terms, which are not negotiable. By viewing or accessing the Website in any manner, Users agree to this Privacy Policy and the Terms. We reserve the right to update this Privacy Policy and the Terms without notice. Each time a User accesses the Website, by doing so he or she agrees to the current version of the Privacy Policy and the Terms as are displayed on the Website at the time of access, and specifically that their Personal Information may be used in accordance with this Privacy Policy. If you do not agree to this Privacy Policy or the Terms, you should not access the Website.

If any part of this Privacy Policy or the Terms are found by a court or administrative body of competent jurisdiction to be void or invalid, the remainder of the Privacy Policy and the Terms shall remain in full force and effect.

Collection of Information

In order for us to operate the Website and comply with Applicable Laws, Users accessing the Website may be asked from time to time to provide Personal Information, or Personal Information such as location data from mobile devices, may be collected automatically. Users’ Personal Information may be stored and processed both by us and by other companies within our group.

We may also use or disclose Users’ Personal Information to third parties:
  1. for the purpose of sending Users promotions, special offers or other information, from us and selected third party partners, which we consider may be of interest to Users (Users may unsubscribe by clicking the link in the email);
  2. for the purpose of sending Users alerts which they have expressly requested;
  3. to tailor the advertising we show Users on the Website;
  4. to understand the effectiveness of the Website and our advertising;
  5. to comply with Applicable Laws or the order of a court or other authority with which we are legally obliged to comply;

However, we accept no responsibility for a failure of a third party to do so, except where that third party is a member of our group.

Payments

Users’ credit card payments are processed by a third party, which has access to Personal Information needed for this purpose, but may not use it for other purposes. We do not have access to or retain any User’s payment information.

Communications Between Advertisers and Other Users

If a User makes contact with an Advertiser via the Website, that User’s Personal Information may be sent to the relevant Advertiser. Advertisers must comply with Applicable Laws and this Privacy Policy in relation to the storage and processing of Users’ Personal Information which we provide. We do not accept any liability for any subsequent communications between Advertisers and other Users.

Advertisers who have subscribed to our call tracking service have elected to have their call enquires generated through the Website. Such calls may be tracked and recorded for training and customer service assessment purposes. Users consent to any such recording by continuing with a call after a message stating that the call may recorded has been played. We may use a third party service provider to record and track calls. If such third party has access to Personal Information, we will require them to store and process that Personal Information in accordance with this Privacy Policy and Applicable Laws.

Calls to Us

Any calls we receive may be tracked and recorded for training and customer service assessment purposes. Users consent to any such recording by continuing with a call after a message stating that the call may recorded has been played. We will store and process any Personal Information collected in this manner in accordance with this Privacy Policy and Applicable Laws. We may use a third party service provider to record and track calls. If such third party has access to Personal Information, we will require them to store and process that Personal Information in accordance with this Privacy Policy and Applicable Laws.

Cookies

Our Website uses cookies, which are small files sent to a User’s computer or mobile device, that allow us to recognise and remember Users. Some of the cookies used on the Website may be essential for its proper operation, others are intended to personalise or enhance the User’s experience or collect data to allow us to improve the Website. We may use cookies to collect and store Personal Information and we may link Personal Information stored by cookies with Personal Information supplied by Users in other ways.

Our third party partners, including Google and Facebook, use cookies to present advertising to Users based on their visits to the Website and/or other sites on the internet.

Security

We will maintain security procedures to protect Users’ Personal Information from unauthorised access, disclosure or loss, in accordance with all Applicable Laws and good industry practice. However, we do not guarantee that Personal Information will not be subject to these things, and, to the extent permitted by Applicable Laws, accept no liability in the event they are.

Users are responsible for keeping their account login details confidential. An account is for a single User and should not be shared. Users are advised to contact us immediately if they think their login details may have been accessed by someone else.

International Transfer of Personal Information

The information that we collect from Users may be transferred to, and stored in a country outside the UAE. It may also be processed by staff operating outside the UAE, who work for us or for one of our suppliers.

Minors

Persons under the age of 18 are not permitted to use the Website. However, in the event that we collect Personal Information relating to someone under the age of 18, we will comply with Applicable Laws.

Enquiries About Personal Information

Users may enquire as to the Personal Information we hold about them by contacting us directly. We will provide a User with details of the Personal Information we hold in respect of them, subject to verifying the User’s identity to our satisfaction. We reserve the right to charge a reasonable admin fee for this service.

Governing Law and Jurisdiction

This Privacy Policy, the Terms and Users’ access to the Website are governed by and construed in accordance with the laws appliable in the Dubai International Financial Centre. We and Users submit to the exclusive jurisdiction of the courts of the Dubai International Financial Centre, provided that we may bring proceedings against Users in any court or forum of competent jurisdiction to enforce our intellectual property rights or the indemnity obligation set out in the Terms.
